Fence Height by Zoning: How Tall Can You Build?

Fence height isn't your decision — it's your zoning department's decision. Every US city restricts fence height by yard location, and the rules vary enough that you have to check yours specifically before ordering anything.
Typical residential fence height limits
- Front yard: 3–4 ft (almost universal)
- Side yard: 6 ft (most cities)
- Back yard: 6 ft standard; 8 ft with permit in many cities
- Corner lot: 3 ft within 25 ft of the corner (sight line)
- Pool enclosure: 4 ft minimum, often 5–6 ft (safety code)
Why front-yard fences are short
Sight lines for drivers and pedestrians, neighborhood aesthetic preservation, and the historical American preference for open front yards. The 3- or 4-ft cap is one of the most enforced fence rules in any city.
Cost jump from 6 to 8 ft
Going from a 6-ft to an 8-ft fence isn't a 33% material increase — it's closer to 50% all-in. More material, deeper posts (42" instead of 36"), more concrete (3 bags per post instead of 2), often a permit fee, and stronger post spacing requirements (6 ft instead of 8 ft for wind resistance).

If you need a fence taller than the standard limit (noise from a busy road, neighboring commercial property, security concerns), you can usually apply for a variance. Process: written application to the zoning board, $200–$800 fee, sometimes a hearing where neighbors can object. Approval takes 6–12 weeks. Approval rates vary wildly by city.
Pool-specific rules
Pool fences are a separate code section. Most US states require a minimum 4-ft fence with self-closing, self-latching gates with latches at least 54" off the ground (so kids can't reach). Vertical pickets must be spaced less than 4" apart. This applies to your perimeter fence if the pool is unfenced inside it.
